JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-12-2021 Heard Mr. Jitendra Kumar Shrivastava, learned counsel for the petitioner and Mr. Nagendra Prasad, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Sahebganj P.S. Case No. 290 of 2020 registered for the offences punishable under Sections 341, 342, 447, 325, 307 and 506/34 of the Indian Penal Code 1860.

The allegation against the petitioner is that he along with other accused persons assaulted the son of the informant, due to which, his jaw has fractured.

Learned counsel for the petitioner submits that both the parties are agnates and there is land dispute between them. Learned counsel further submits that the allegation against the petitioner is general and omnibus in nature and the petitioner is

Patna High Court CR. MISC. No.32179 of 2021(2) dt.15-12-2021 2/2 in custody since 24.8.2020. Learned counsel next submits that the petitioner has got no criminal antecedent. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that both the parties are agnates, there is land dispute between them, the petitioner is in custody since 24.8.2020 having no criminal antecedent and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 1st, Muzaffarpur (West) in connection with Sahebganj P.S. Case No. 290 of 2020. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
