JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kundwa Chainpur P.S. Case No. 154 of 2022 registered for the offence punishable under Sections 302 & 120-B/34 of the Indian Penal Code and under Section 27 of the Arms Act. As per the F.I.R, the brother of the informant was the Mahanth of Hanuman Mandir. On 21.01.2022 at about 1:00 P.M. his brother was taking rest in the Baithaka near the temple. Upon hearing the sound of gunshot, he reached towards the temple and saw that three miscreants on one bike and two miscreants on another bike armed with pistol were fleeing away. When the informant went near Baithaka, he found her brother in dead condition and blood was oozing from his head.

In this view of the matter, I am not inclined to grant bail to the petitioner. Accordingly, this regular bail application is dismissed. The trial court is directed to expedite the trial and conclude the same as early as possible.
