This is a petition for grant of regular bail for offence under Sections 414 of the Indian Penal Code and 47(a) of the Bihar Excise Act, 2016.

Eighteen liters of foreign made liquor was recovered from the motorcycle on which the petitioner was also there. Recovery was made on 17.07.2016.

Submission of the petitioner is that possession of foreign liquor was not an offence on the date of occurrence. The petitioner is in jail since 18.07.2016.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Matihani P.S. Case No. 80 of 2016 to the satisfaction of Mr. Pushpendra Kumar Pandey, Judicial Magistrate, 1st Class, Begusarai, or successor Court. (Birendra Kumar, J) SA/- U √ T √
