The petitioners are apprehending their arrest in connection with Sarairanjan P.S. Case No. 267 of 2012 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 307, 380 and 504 of the Indian Penal Code.

The allegation against the accused persons is that they along with 5-6 persons came and started assaulting the informant with lathi, danda, farsha etc and when his grand sons namely Amrendra Kumar and Suman Kumar came for saving, they were also assaulted by them. It is further alleged that the petitioner Sanjay Thakur is said to have assaulted on the informant by means of farsha and also taken Rs. 150/- from his pocket and a

Patna High Court Cr.Misc. No.15346 of 2017 (2) dt.07-04-2017 2/2 gold chain of Rs. 30,000/- from the neck of Amrendra. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is a case and counter case between the parties. There is land dispute also between the parties. Both the sides are said to have been injured in course of free fight. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sarairanjan P.S. Case No. 267 of 2012 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
