JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with N.T.P.C. P.S. Case No. 39 of 2014 registered for the offences punishable under Sections 341, 323, 504, 498A and 506 of the Indian Penal Code.

The petitioners are Nanand and Nandoshi of the informant having general and omnibus allegation for torturing the informant for non-fulfillment of demand of dowry and also after the death of her husband they are assaulting her.

Patna High Court Cr.Misc. No.51506 of 2014 (2) dt.07-05-2015 Submission is of false implication and that the mother-in-law and father-in-law have already been allowed prearrest bail by another Bench of this Court vide order dated 5.1.2015 passed in Cr. Misc. No. 51608 of 2014 and, as such, the petitioners also deserve sympathetic consideration to which the learned APP duly assisted by the learned counsel for the informant opposes.

In the facts and circumstances stated above and considering the relationship of the petitioners with the informant, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Anwar Shamim, J. M. Ist Class, Bhagalpur in connection with N.T.P.C. P.S. Case No. 39 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
