This is a petition for grant of anticipatory bail for offence under Sections 379 of the Indian Penal Code, 40 of the Bihar Mining Mineral Concession Rules, 1972, and 8(d) of the Bihar Mineral Illegal Transport and Storage Act.
Allegation is that the petitioners were drivers of the tractors, which were carrying sand obtaining of illegal mining. The petitioners have produced the chalan and permit for carrying the State sand.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be

No.20834 of 2017 (2) dt.12-05-2017 2/2 released on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Nawadah Muffasil P.S. Case No. 18 of 2017 to the satisfaction of the Chief Judicial Magistrate, Nawadah, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
