JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioners seeks regular bail in connection with Phulparas P.S. Case No. 131 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 353, 307, 272, 273 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition and Excise Act and Section 25(1-b)A, 26, 35 and 27 of the Arms Act.

Allegation as per F.I.R. is that police on information that some miscreants are firing and police raided the place and thereafter the accused persons were apprehended including the petitioners.

Submission of learned counsel for the petitioners is that the recovery is from the house of co-accused Sunil Yadav and not from the house of the petitioners. Further no specific

Patna High Court Cr.Misc. No.74879 of 2018(2) dt.21-12-2018 2/2 allegation has been attributed against the petitioners and they are in judicial custody for more than three and half months. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge (Excise Act) Madhubani, in connection with Phulparas P.S. Case No. 131 of 2018.
