The Petitioner is apprehending his arrest in a case registered for the offence punishable under Section 302 of the Indian Penal Code.
The daughter of the informant had entered into love marriage with the petitioner one year prior to the death. Both were living in a rented house. The land owner informed to the informant on telephone that his daughter is dead and the petitioner is missing. Hence, the petitioner is suspected to have committed murder and fled away.
Submission of the petitioner is that later on the informant's son filed affidavit that he had sent wrong message.

Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner in connection with Kanti Police Station Case No. 344 of 2016, pending in the Court of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur/Successor Court.
Accordingly, the prayer for anticipatory bail is refused. (Birendra Kumar, J) Mkr./- U T
