JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Begusarai (Muffasil) P.S. Case No. 399 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code.
Allegation as per F.I.R that three motorcycle borne miscreants chased the informant and looted away cash of Rs. 79,811/- kep in a bag besides the said amount a lenovo tab, printer and cash of Rs. 48,00/- and 7300/- and some ATM cards. It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and nothing has been recovered from the possession of the petitioner and the mobile, which has been recovered from the possession of the petitioner is his own mobile phone. Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai (Muffasil) P.S. Case No. 399 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
