Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

153 liters of liquor was recovered from a car on which the petitioners were also there. The petitioners are in custody since 03.03.2021. The petitioners have stated on oath that they have got no criminal antecedent.

Considering the facts aforesaid, let the petitioners,

Patna High Court CR. MISC. No.31632 of 2021(2) dt.27-10-2021 2/2 above named, be released on bail after framing of the charge so that trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Excise Case No.92 of 2021, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
