The petitioner apprehends his arrest in connection with Atri P.S. Case No. 169 of 2013 registered under Sections 341, 323, 324, 325, 326, 307, 385, 504, 506 and 379 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Gaya.

The accusation is that petitioner gave Garasa blow at the head of the son of the informant causing bleeding injury in course of occurrence.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and has falsely been implicated in this case due to lodging a complaint case bearing

Patna High Court Cr.Misc. No.51385 of 2014 (2) dt.14-05-2015 Complaint Case No. 1560 of 2013 by the petitioner against the informant and his son regarding snatching of the motorcycle. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
