====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bihiya (Bahoranpur O.P.) P.S. Case No. 279 of 2016, instituted for the offence under Sections 399, 402 of the Indian Penal Code, Sections 25(1-B)A, 26 and 35 of Arms Act.

In the written report it is alleged that Motilal Thakur was arrested by the police and one country made Katta and three live caertridges have been recovered from his possession. He disclosed the name of petitioner before the police that petitioner along with accused persons as named in the written report have assembled to distribute looted money from Sanjay Singh.

Counsel for the petitioner submits that Moti Lal Thakur has already been granted bail by coordinate Bench of

Patna High Court Cr.Misc. No.72520 of 2018(2) dt.05-12-2018 2/2 this Court vide order dated 6.4.2018 passed in Cr. Misc. 15302 of 2017.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Bihiya (Bahoranpur O.P.) P.S. Case No. 279 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
