The petitioner is seeking anticipatory bail in connection with Hathwa P.S. Case No. 106/2015, in Trial No. 1640/2018 registered under Sections 379 and 420 of the Indian Penal Code and under Section 66(c) of the I.T. Act. Learned counsel for the petitioner submits that petitioner is having Franchise of ANI who is a service provider of Internet. Earlier in connection with the F.I.R. on 22.06.2015 giving rise to Hathwa P.S. Case no. 106/2015 under Section 379 and 420 of the I.P.C. and Section 66(c) of the I.T. Act one Rahul Kumar Jha was charge-sheeted and was facing trial. Learned counsel submits that the petitioner had been made prosecution witnesses in the said case and had deposed accordingly. It is thereafter that Rahul Kumar Jha has filed application under
Patna High Court Cr.Misc. No.75219 of 2018(2) dt.20-12-2018 2/2 Section 319 of the Code of Criminal Procedure and thereunder the petitioner has been summoned by the trial court. In the given facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Hathwa P.S. Case No. 106/2015, Tr. No. 1640/2018, subject to condition under Section 438(2) of the Code of Criminal Procedure.
