JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-11-2021 Heard Mr. Satya Prakash Parasar, the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Jamui P.S. Case No. 51/2019 instituted for the offences under Sections 147, 149, 158, 30/120(B) of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 04.06.2020 passed in Cr. Misc. No. 80889 of 2019.

The petitioner is in custody since 12.04.2020. This Court had called for a report about the stage of the case from the court below. The report which has

Patna High Court CR. MISC. No.32238 of 2021(3) dt.24-11-2021 2/2 since been received indicates that the trial has not proceeded and the case is at the appearance stage only. Considering the nature of accusation against the petitioner, I am not inclined to grant bail him for the present. However, looking at the period of custody of the petitioner, this Court directs that if there is no substantial progress in the case in the next six months, it would be open for the petitioner to approach this Court again for grant of bail.
