JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-08-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khiri More P.S. Case No. 89 of 2019 for the offence under Sections 120B, 115, 379 and 411 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. On the basis of secret information, the police conducted raid. From possession of the petitioner one country made Katta with a live cartridge was recovered and one motorcycle was also seized. Petitioner is in custody since 07.11.2019.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for nearly nine
