Petitioner is in custody since 01.11.2016 in connection with Dehri (Town) P.S. Case No. 398 of 2016 registered under Sections 302, 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case on account of a land dispute. The petitioner, who is of 62 years of his age, is suffering from chronic disease and have no criminal antecedent. The petitioner is languishing in custody for the last three months. Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioner is named in the F.I.R. alleging that he has assaulted the informant's husband, resultantly, he died. Moreover, prosecution version has been supported by the witnesses,

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. However, the petitioner is at liberty to renew his prayer for bail after framing of charge. (Arvind Srivastava, J) brajesh/- U T
