Md. Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Barbigha P.S. Case No. 86 of 2018 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

Learned counsel for petitioner submits that recovery has been made from Pustakalay Maidan which will be apparent from the seizure list. It has further been submitted that seizure list does not bear signature of this petitioner. It is further pointed out that police has implicated this petitioner merely on suspicion.

Petitioner is in custody since 1.11.2018.

It is mentioned in para 3 that other cases of Excise Act

Patna High Court Cr.Misc. No.74398 of 2018(2) dt.13-12-2018 2/2 is also pending against this petitioner.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I, Sheikhpura in connection with Barbigha P.S. Case No. 86 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. The petitioner will file affidavit at the time of filing bail bond that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in instant case will liable to be cancelled.
