JUSTICE PARTHA SARTHY ORAL ORDER 17-12-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 365, 367, 368 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that on the daughter of the informant reaching near the vehicle in question, the accused persons forcibly made her to sit in the vehicle and tried to get away. However, on hulla being raised and at the intervention of the co-villagers, she was rescued and the three accused persons including Sintu Kumar and the petitioner herein were caught.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The

No.32345 of 2021(2) dt.17-12-2021 2/2 case of the petitioner stands on a similar footing to the FIR named co-accused Sintu Kumar who has been enlarged on bail vide order dated 25.10.2021 passed in Cr. Misc. No. 41691 of 2021. The petitioner is in custody since 13.7.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case including grant of bail to the FIR named co-accused Sintu Kumar and the petitioner having remained in custody for more than 1 year 5 months, the petitioner is directed to be enlarged on bail in connection with Shahjahanpur P.S. Case no. 59 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge cum Exclusive Special Judge, POCSO Act, Patna.
