JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Chausa P.S. Case No. 136/2016 instituted for the offence under sections 47(a) of Bihar Excise (Amendment) Act, 2016.
It is alleged that police raided the line hotel alleged to belong to this petitioner and recovered 10 bottles of foreign liquor, totaling 2 liters 385 ml. The son of this petitioner was apprehended on the spot who disclosed the name of this petitioner. The seizure list bears the signature of son of this petitioner. From the written report, it is apparent that petitioner was not found on the spot. There is no recovery of foreign liquor from his conscious possession.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Chausa P.C. Case No.136/2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Udakishunganj, Madhepura, subject to the conditions as laid down under Section 438(2) Cr.P.C.
