JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 10978 of 2018, arising out of Digha P.S. Case No. 581 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 307, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 37(b)(c) of Bihar Excise Act.

Allegation as per FIR against the petitioner and other accused persons is of assaulting and firing and further allegation is that one of the co-accused was in drunken condition. Submission of learned counsel for the petitioner is that as a matter of fact an attempt was made to outrage the modesty of sister of the petitioner by the informant and others and on protest petitioner's side also received injuries and in order to save their skin the present case has been filed and no

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No. 10978 of 2018, arising out of Digha P.S.Case No. 581 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
