JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Mahnar P.S. Case No. 51 of 2020 for the offence under Section 414 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 8, 20(b)(ii),(B), 22, 25 and 29 of the Narcotic Drugs & Psychotropic Substances Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 20.02.2020.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he was sitting in the vehicle where on search a plastic bag was found in the
Patna High Court CR. MISC. No.21036 of 2020(2) dt.29-06-2020 2/2 dickey of the said vehicle and one country made pistol and other articles were recovered. The vehicle in question does not belong to the petitioner.
Considering the fact that the petitioner has no criminal antecedent and he is since 20.02.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 51 of 2020, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of one month in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
