JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in Brahmpura P.S. Case No. 124 of 2013 registered under Sections-307, 302 & other minor sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 27-06-2013 and charge against the petitioner has already been framed on 08-072015. It is also submitted that having more or less similar allegation, co-accused namely, Pappu Sahani @ Amit Kumar Sahni and Aditya Prakash @ Balajee have already been granted privilege of bail by coordinate benches of this court by orders dated 25-10-2013 and 30-09-2013 passed in Cr. Misc. Nos. 35560

Patna High Court Cr.Misc. No.691 of 2017 (3) dt.22-02-2017 2/2 of 2013 & 36478 of 2013 respectively.

Considering the above-said facts and circumstances of the case as well as submission of the parties as also the period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Brahmpura P.S. Case No. 124 of 2013 corresponding to Sessions Trial No. 677 of 2014 to the satisfaction of A.D.J.-VIII, Muzaffarpur.
