The petitioner apprehends her arrest in connection with Riga P.S. Case No.236 of 2016 registered under Sections 363 and 366(A)/34 of the Indian Penal Code.
The accusation is that on 28.10.2016, Lalit Kishore Ram came to the house of the informant to teach his daughter Puja Kumari and took away his daughter to Ramnagra Bazar on the pretext of purchasing a book. When the daughter of the informant did not return, his wife started to trace out her but no trace of her was found. Thereafter, the wife of the informant gave information
Patna High Court Cr.Misc. No.19084 of 2017 (3) dt.20-07-2017 2/3 to her brother Pawan Kumar, who informed her that in course of returning from Ramnagra Bazar, he had seen Lalit Kishore Ram, Chalitar Ram, Jahri Devi, Hari Kishore Ram, Raj Kishore Ram and this petitioner taking away his daughter on a Bolero vehicle. Later on, Lalit Kishore Ram through his mobile phone informed the informant on his mobile phone that his daughter is at Lucknow and asked him to come immediately to take her. Thereafter, the informant went to Lucknow and tried to search his daughter but no trace of her was found.
Learned counsel appearing on behalf of the petitioner submits that there was love affair in between the daughter of the informant and Lalit Kishore Ram but with an ulterior motive, the petitioner, who is the sister of Lalit Kishore Ram, and her other family members have also been implicated in this case. The petitioner is lady and she has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No.236 of 2016, subject to the conditions laid down under
