JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Mehandia P.S. Case No. 39 of 2016, registered under Sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. In course of investigation, it has only come in the statement of witnesses, namely, Biranjan Rajbanshi and Ram Pravesh Rajbanshi that they heard from the villagers regarding hand of the petitioners in the occurrence, except that there is no material against the petitioners to show their involvement in the present case. The petitioners having no criminal antecedent are in custody since 04.07.2016.

No.3180 of 2017 (2) dt.08-02-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in connection with Mehandia P.S. Case No. 39 of 2016.
