Petitioner seeks regular bail in connection with University PS Case No. 24/2013 registered for the offence punishable under Sections 420/467/468/471/120(B) of the IPC. The allegation, in a nutshell, is that the petitioner taking advantage of his service in Bihar University provided forged and fabricated mark-sheet and provisional certificate of BA and LLB in favour of co-accused Ranjit Singh, a resident of Tehsil Zira, Punjab by manipulating Tabulation Registers and the records of the University.
Learned counsel for the petitioner submits that the petitioner is aged about 69 years and has falsely been implicated
Patna High Court CR. MISC. No.32652 of 2021(3) dt.21-02-2022 2/3 in this case after his retirement in 2012 from the post of clerk. He further submits that another FIR was lodged against the said co-accused, Ranjit Singh bearing Zira PS Case No. 105-1/2013 in which he has been convicted by the Sub Divisional Judicial Magistrate, Zira in connection with CIS No. CHI/0000733/2013 and punishment of three years was awarded to him. Learned counsel referring to paragraph-7 of the petition submits that the petitioner had no knowledge about the FIR and NBW being issued in January 2021 and thereafter, he was arrested. It is next submitted that petitioner is in custody since 02.03.2021, charge-sheet has been submitted on 27.05.2021 and there is no likelihood that petitioner will abscond or will tamper with the evidences. He next submits that the charges are based on documentary evidence.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner being 69 years old is in custody since 02.03.2021, chargesheet has been submitted, and there is no likelihood that petitioner will abscond or will tamper with the evidences, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, BRAJ BHUSHAN
Patna High Court CR. MISC. No.32652 of 2021(3) dt.21-02-2022 3/3 SHARMA be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with University PS Case No. 24/2013.
