2. The petitioner has preferred this application for grant of regular bail in connection with Kalyanpur P.S. Case no. 429 of 2024 registered under sections 127(1), 127(2), 115(2), 303(2), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that 3-4 unknown accused persons hired his vehicle. On informant going to reach them at their destination, the informant was overpowered, the accused tied up his hands and legs and escaped with his vehicle.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. He was falsely implicated in the case in course of investigation in the confessional statement of the co-accused Lal Saheb made before police. The said Lal Saheb has

Patna High Court CR. MISC. No.22082 of 2026(3) dt.15-07-2026 2/2 been enlarged on bail vide order dated 19.11.2025 passed in Cr. Misc. no.75068 of 2025. The petitioner is in custody since 15.9.2025 and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation, grant of bail to the co-accused on whose confessional statement before the police the name of the petitioner transpired and the petitioner having remained in custody since 15.9.2025, the Court directs the petitioner to be enlarged on bail in connection with Kalyanpur P.S. Case no. 429 of 2024 (G.R. no.7144 of 2024) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
