The petitioner seeks pre-arrest bail in connection with Patrakar Nagar P.S.Case No. 188 of 2015 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. It is contended that the petitioner had taken loan of Rs.10 lakhs from the Bank for purchase of Mahindra Scorpio Car. Pursuant to the sanction of loan, the petitioner purchased the car and is regularly paying the installments due to the Bank. Referring to paragraph 30 of the case diary, it has been contended that by now more than rupees five lakhs have been deposited by the petitioner in the loan account.

Learned counsel for the State has submitted that it

Patna High Court Cr.Misc. No.44716 of 2015 (3) dt.13-01-2016 2/2 would be evident from the case diary that Rs.6,88,149/- is yet to be paid by the petitioner against the loan advanced to him. Regard being had to the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner vide order dated 15.10.2015 is hereby confirmed.
