The petitioners have preferred this application for grant of regular bail in a case registered under sections 413 and 414 of the Indian Penal Code.

As per the prosecution case, on a raid being conducted, it is stated that the four accused persons including the two petitioners herein were caught while others managed to escape. Eight stolen motorcycles were recovered from their possession.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They were apprehended under a misunderstanding. They have no concern with the seized motorcycles. They are in custody

Patna High Court CR. MISC. No.32032 of 2021(2) dt.23-12-2021 2/2 since 7.1.2021 and have no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioners not having any criminal antecedent and having remained in custody for 11 months, the petitioners are directed to be enlarged on bail in connection with Raghunathpur P.S. Case no. 5 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Siwan.
