JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 20(B), 22, 23 and 24 of NDPS Act. From a car 55 Kilograms ganja was recovered near village Sonaha Bazar, P.S.-Palanwa, District-East Champaran. Allegation is that the petitioner was apprehended while attempting to flee away from the said vehicle. Petitioner has stated on oath that he has got no criminal antecedent and he is in custody since 8.3.2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.47763 of 2016 (7) dt.29-03-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran at Motihari/Successor Court, in connection with Palanwa P.S. Case No.11 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
