The petitioner is apprehending his arrest in connection with Alauli P.S.Case No.223 of 2016 registered for offences punishable under Sections341, 323, 447, 504, 506, 307 and 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that though the petitioner is named in the F.I.R. but there is no specific allegation of any overt act against the petitioner and he is aged about 65 years. So far antecedent of the petitioner is concerned, it has been submitted that he has been falsely implicated in those cases at the instance of the informant.
Heard learned A.P.P. also.
Having heard both sides and in view of allegation and
Patna High Court Cr.Misc. No.10190 of 2017 (2) dt.18-03-2017 2/2 criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court, considering the age of the petitioner and other materials available on record.
With the aforesaid observation, this application is disposed of.
