NILU AGRAWAL ORAL ORDER 28-11-2016 Heard the learned counsel for the petitioner and the learned APP for the State.
Petitioner is languishing in judicial custody since 27.06.2016 in connection with Kartaha P.S.Case No.39 of 2016 for offence alleged under Section 414 of the IPC. The prosecution case is that the police on patrolling duty saw a person coming on Passion motorcycle bearing registration no.BR-31E-6164 and on interception, he tried to flee away, but he was caught and on interrogation, he disclosed his name as Ranjit Sahni and did not provide any papers and documents and did not gave any satisfactory reply with regard to the seized motorcycle.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.41975 of 2016 (4) dt.28-11-2016 2/2 petitioner that he is innocent and has been falsely implicated in the aforesaid case. He further submits that no other case of a similar nature is pending against him and that the number of the motorcycle in the FIR is BR-31E-6164 but in the seizure list, the registration number is completely different, i.e., BR-06E-6164, hence the prosecution case is not supported by the seizure list. However, learned APP for the State submits that the petitioner was apprehended by the police, hence opposes the prayer for bail.
Be that as it may, considering the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Vaishali at Hajipur in connection with Kartaha P.S.Case No.39 of 2016.
