Petitioner seeks bail in Nathnagar P.S. Case No.08 of 2015 instituted for the offence under Section(s) 20(B)©/23(c), 25 of the NDPS Act, pending in the Court of the Additional Sessions Judge, 1st, Bhagalpur.

Counsel for the petitioner submits that petitioner is in custody since 11.08.2015.

A report was called for from the Court below, which has been received from which it appears that all the prosecution witnesses have been examined. The case is fixed for defence witness.

In view of such, this Court is not inclined to enlarge the petitioner on bail at this stage.

Prayer of the petitioner for grant of bail is rejected at this stage.

The trial Court is directed to conclude the trial positively within a period of four months from the date of receipt of a copy of this order either by fixing the case on day to day basis or by giving short adjournments.

Liberty is given to the petitioner to renew his prayer for bail after four months, if trial is not concluded within aforesaid period.
