The petitioner apprehends his arrest in Kusheshwar Asthan P.S. Case No. 169 of 2014 registered under section 307 and other allied sections of the Indian Penal Code and 27 of the arms Act.

According to the first information report it is alleged that while the informant was going to attend the call of nature, the petitioner along with other accused persons assaulted the informant due to land dispute.

Learned counsel for the petitioner submits that the instant case is a counter blast of the earlier case lodged by the

Patna High Court Cr.Misc. No.43765 of 2015 (2) dt.14-10-2015 2/2 father of the co-accused Chhotu Yadav.

In view of the allegation that the firing opened by the petitioner hit on the right hand of the informant, I am not inclined to grant anticipatory bail to the petitioner. Accordingly the same is rejected.
