Petitioner apprehends arrest in connection with Special Case No. 36 of 2018 RC No. 16/A/17 Reg. No. 20/17 registered for the offence punishable under sections 13(2) read with 13(1)(e) of P.C. Act 1988.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. In calculation the income of wife and the income from HUF has not been considered, which is in violation of the letter issued by CBI dated 29.11.2001 as contained in Annexure-P/4. The wife of the petitioner is a practicing advocate at Civil Court, Dhanabad since 2006 and she has

Out of the alleged three flats, one flat is owned by this petitioner and other two belongs to the maternal grand mother of the petitioner's wife. The plot in question is not in Bhabhua Town rather it is in rural area. Further, out the alleged two vehicles, the motorcycle was gifted to this petitioner at the time of marriage and the four wheeler is not in his name as is evident from registration documents contained at AnnexureP/8. Further, there are grave mistakes in calculations made by the authorities. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Sessions Judge-cum-Spcecial Judge CBI-I, Patna in connection with Special Case No. 36 of 2018 RC No. 16/A/17 Reg. No. 20/17 subject to the conditions laid down under section 438(2) Cr.P.C.
