Today learned counsel for the petitioner is pressing this application for petitioner no. 2.

Heard learned counsel for the petitioner and learned APP for the State.

The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bibhutipur P.S. Case no. 467 of 2021 instituted for the offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Patna High Court CR. MISC. No.23285 of 2022(3) dt.10-11-2022 2/3 reached at the petitioner house. Petitioner started to raise alarm that unknown person has entered into her house, upon which local people gathered there and killed him.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and have committed no offence. Informant is not an eye witness of the alleged incident. Petitioner is a lady and she raised voice against entry of an unknown at her house upon which local persons gathered there and kill him. Petitioner was not having intention of killing the deceased rather the incident occurred at the spur of moment. An FIR was also registered against the deceased and two unknown persons by the husband of petitioner nos. 2.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner no. 2 on bail. The petitioner no. 2 directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Bibhutipur P.S. Case no. 467 of 2021, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like
