Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with N.D.P.S. Case No. 60 of 2022 arising out of Raxaul P.S. Case No. 360 of 2022 registered for the offence under Sections 20(b), II(b), 23 and 27(A) of the NDPS Act.

Learned counsel for the petitioner submits that from the possession of the petitioner 125 gms. Of smack was recovered which is an intermittent quantity.

Learned counsel for the petitioner also submits that the petitioner is in custody since 25.07.2022.

Patna High Court CR. MISC. No.25818 of 2023(2) dt.19-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the recovery of intermittent quantity and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Additional Sessions Judge, Vth, East Champaran, Motihari in connection with N.D.P.S.
