JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 413, 414, 420, 467, 468 and 471 of the Indian Penal Code.
One Bittu Mishra is said to have been caught with motorcycles and on the basis of his disclosure near about 11 socalled stolen motorcycles are said to have been recovered from the garage of the petitioner. Similarly, some motorcycles were also recovered from the garage of other accused.
Submission on behalf of the petitioner is that the petitioner is mechanic in a garage and, as a matter of fact, some

No.40446 of 2016 (3) dt.22-11-2016 2/2 old motorcycles had been kept in his garage and there is nothing on the record to show that the seized motorcycles were stolen motorcycles. It is further submitted that the investigation against the petitioner has already been completed and petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, West Champaran in connection with Sathi P.S. Case No.96 of 2016.
