JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 482 of 2012 registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471 of the Indian Penal Code.
Admittedly, petitioner was Mukhiya of Gram Panchayat at the relevant time and she was President of Managing Committee but no specific overt-act has been attributed against the petitioner nor she has been named in the first information report. Moreover, some co-accused persons have already been granted privilege of anticipatory bail by different Benches of this court including this Bench.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.1500 of 2015 (2) dt.15-01-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sour Bazar (Patarghat O.P.) P.S. Case No. 482 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
