Mr.Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 385, 387, 379, 504, 506, 34 of the Indian Penal Code. As per the prosecution case, these petitioners assaulted driver of the truck of the informant and demanded ransom of Rs. 5 lakhs of the truck.

It is submitted on behalf of the petitioners that the petitioners are the owners of the truck in question and on 10.07.2021, petitioner No.1 handed over said truck to one Jafar Khan on Rs. 60,000/- per month rental amount as the petitioner

Patna High Court CR. MISC. No.23094 of 2023(2) dt.26-06-2023 2/2 No.1 had to go to Delhi for treatment of his mother and after returning from Delhi, petitioner No.1 demanded rental amount from Jafar Khan but he refused to pay it and also refused to return back the said truck of the petitioners. Learned A.P.P. for the State as well as learned counsel for the informant both have opposed the bail petition of the petitioners and submit that during the course of investigation, it has come that trucks in question is registered in the name of informant which was purchased from Jafar Khan and the said trucks was also released by the Court in favour of informant. Considering the aforesaid facts and circumstances and nature of allegation, I am not inclined to grant bail to the petitioners. Therefore, the prayer for bail of these petitioners is dismissed.
