2. The petitioner apprehends arrest in a case registered for the offence punishable under section 3 of the RP UP Act for theft of 35 batteries from the railways installation.

3. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

4. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of

Patna High Court CR. MISC. No.24598 of 2024(2) dt.24-04-2024 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Barauni in Bachhwara RPF Police Station Case No. 01/2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
