Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 302/307/120B/506/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is main assailant. He is in custody since 10.07.2017.
In the past prayer for bail was refused on 19.04.2018 and thereafter on 26.09.2019. The order dated 26.09.2019
Patna High Court CR. MISC. No.20996 of 2020(3) dt.02-11-2020 2/2 reveals that the trial Judge had reported that the trial is likely to conclude within four months. The report of the trial Judge dated 27.07.2020 reveals that trial has not concluded in spite of cooperation of the petitioner. Petitioner is ready to cooperate the trial.
Considering the period already undergone by the petitioner as undertrial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.435 of 2017, arising out of Khagaria (Muffasil) P.S. Case No.274 of 2017, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
