JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-09-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is in custody in connection with G.R.P. Patna P.S. Case No. 614 of 2019 for offences under Sections 379, 411 and 414/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that the allegation against the petitioner is that he was involved in sale of stolen motorcycle. Learned counsel submits that the petitioner was not named in the FIR and his name transpired on the basis of confessional statement of coaccused, namely, Sumit Kumar. Petitioner is in custody since 15.11.2019.

No.25432 of 2020(2) dt.29-09-2020 2/2 Considering the fact that the petitioner was not named in the FIR and his name transpired on the basis of confessional statement of co-accused, namely, Sumit Kumar, the Court is inclined to grant bail to him, subject to the condition that the petitioner has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Patna in connection with G.R.P. Patna P.S. Case No. 614 of 2019.

Deposit of Rs.25,000/- (Rupees twenty thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
