Although this writ petition is filed questioning the order of termination of the petitioner from the post of 'Subject Matter Specialist' on grounds that he did not possess the eligibility qualification fixed in the advertisement, a copy of which is present at Annexure-1 which, inter alia, requires the petitioner to pass National Eligibility Test and which qualification has admittedly not been obtained by the petitioner but when this matter was taken up for consideration, learned counsel for the parties were in agreement that the issue raised in this writ petition stands concluded in a judgment and order of this Court passed in CWJC No.5768 of 2014 (Rakesh Kumar Prasad vs. Bihar Agricultural University) and analogous cases when a Bench of this Court in examination of the rival contentions has not found the issues raised by the appointee worthy of indulgence.
The batch of writ petitions were dismissed and the same consequence would follow in the present writ petition as well, which is accordingly dismissed.
