The petitioners seek bail in connection with Durgawati P.S. Case No.99 of 2014 registered under Sections 302/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that the petitioners are not named in the F.I.R. In course of investigation, it has only come in restatement of the informant (paragraph-6 of the case diary) and one witness, namely, Sanjay Yadav (paragraph-7 of the case diary) that the petitioners used to come at the chamber of the deceased Pintu Lal and take liquor.

No.40784 of 2016 (3) dt.27-01-2017 2/2 While the deceased used to make protest in taking the liquor by the them in the chamber but they used to take the liquor in the chamber of the deceased. In the night of the occurrence, the petitioners had come in the chamber of the deceased for taking the liquor. Except suspicion raised by the informant and the witness Sanjay Yadav, there is nothing against the petitioners to show their involvement in the present case. The petitioners having no criminal antecedents are in custody since 29.07.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Durgawati P.S.
