Heard learned counsel for the petitioner and the State. The petitioner is aggrieved by and dissatisfied with the order as contained in Memo No. 897 dated 21.09.2021 issued by the Engineer-in-Chief-cum-Special Secretary, Public Health Engineering Department, Government of Bihar, Patna and the order as contained in Memo No. 1728 dated 17.12.2021 issued by the Office of Executive Engineer, P.H. Mechanical

Patna High Court CWJC No.6338 of 2022(2) dt.28-03-2023 2/2 Division, Patna.

Learned counsel for the petitioner submits that the petitioner has been transferred from P.H. Division, Patna to P.H. Division, Darbhanga within a period of 28 days of his transfer. It is, however, not denied that the petitioner was transferred to P.H. Division, Darbhanga only one year back and he was brought to Patna only for providing him an opportunity to get treatment of his mother.

Learned counsel for the petitioner is unable to demonstrate any malafide in the fact that the petitioner has now been again sent back to his place of posting where he was transferred only one year back.

This writ application has no merit. It is dismissed accordingly.

Certified copy of this order shall be made available only after removal of the defects.
