JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section392 of the Indian Penal Code, in which, Sections-395, 412 of the Indian Penal Code was also added.
Petitioner is not named and it appears from perusal of perusal of 42 of the case diary that on the basis of confidential information, one Gulshan Kumar was arrested and the said coaccused confessed his guilt, disclosing the name of the petitioner. Admittedly, nothing has been recovered from conscious possession of the petitioner and except the aforesaid confessional statement of co-accused, there appears to be nothing against the petitioner.
Patna High Court Cr.Misc. No.41206 of 2016 (4) dt.24-11-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kanti P.S. Case No. 349 of 2015 corresponding to Sessions Trial No. 60 of 2016 to the satisfaction of Learned Additional Sessions Judge-X, Muzaffarpur.
