JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Bathnaha P.S. Case No. 200/2022, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner was not present at the place of occurrence. Petitioner is in custody since 03.11.2022. From the F.I.R. it appears that the petitioner and two others were seen running away after killing the deceased and the Lalu Jha was having a pistol and it seems that Lalu Jha has shot the deceased.

Patna High Court CR. MISC. No.22779 of 2023(2) dt.17-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sitamarhi in connection with Bathnaha P.S. Case No. 200/2022.
