The petitioner apprehends his arrest in Chapra Muffasil P.S. Case No. 187/2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case on mere suspicion. Even during course of investigation witnesses have simply suspected the hands of the petitioner. On the other hand, learned Additional P.P. informed that the petitioner has stated in para 3 of the bail petition that only two cases are pending against the petitioner, but from perusal of para 57 of the case-diary, it appears that as many as five cases are pending against the petitioner. Patna High Court Cr.Misc. No.44783 of 2015 (4) dt.22-12-2015 antecedent and the cases registered under Section 392 of the Indian Penal Code and Arms Act.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
