The petitioner seeks bail in connection with Sakra P.S. Case No. 164 of 2016 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A), 50, 57 of the Bihar Excise (Amendment) Act, 2016.

The allegation against the petitioner is of recovery of illicit foreign liquor.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner rather it has been recovered from the National Highway (NH) and the petitioner has remained in custody since 23.06.2016. It is also submitted that the petitioner has no

Having heard both sides, in view of the fact stated above as well as there is no compliance of Section 100 of Cr.P.C. and remained in custody about six months, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub Judge-XIII cum Additional Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case No. 164 of 2016.
