JUSTICE ASHUTOSH KUMAR) Date : 29-07-2022 Heard Mr. Arvind Kumar Sinha, learned Advocate for the petitioner and Mr. Alok Ranjan for the State. After some arguments, learned advocate for the petitioner seeks the leave of this Court to withdraw this petition in order to enable the petitioner to prefer an appeal before the appellate authority against the order of cancellation of license. Mr. Alok Ranjan, learned advocate for the State, however, submits that the license of the petitioner was granted under the Control Order of 2001 and therefore, under the new order of 2016, perhaps the appeal may not be maintainable.

Conceding the request made on behalf of the petitioner, the writ petition is permitted to be withdrawn with liberty to the petitioner to approach the appellate authority in appeal against the order of cancellation of license.

Should such an appeal be filed within a period of thirty days, the appellate authority shall take up the matter and after giving reasonably sufficient time to the petitioner to represent his cause, shall pass a final order within the next sixty days with reasons in support of such order. The order so passed shall be made available to the petitioner forthwith.

With the aforesaid direction/observation, the petition stands disposed of.
